# Trademark Filing

Our filing technology prepares your EUIPO, BOIP and WIPO trademark applications in one flow. Your attorney files them once you have confirmed, and nothing is ever filed without an attorney's sign-off.

## What it does

Our filing technology turns your decision to protect a mark into a correct application. It collects the data once, checks it, and prepares it for the right office in the right form. Nothing is filed without an attorney's sign-off, and the attorney stays responsible for the choice of mark, classes, specification and territory.

It sits at the end of [trademark clearance](https://www.pitch.law/solutions/trademark-clearance), so that the goods and services and the jurisdictions cleared are the ones filed, and at the start of [trademark registration](https://www.pitch.law/solutions/trademark-registration), where the filed application is followed to registration.

## Functions

### Application drafting

The application is drafted as a working file: applicant details, the sign (word, figurative or combined), priority claims, and the list of goods and services. The draft can be reopened and amended by the attorney until it is confirmed.

### Goods and services from harmonised terms

For the EUIPO, goods and services are selected from the Office's harmonised terms, structured according to the [Nice classification](https://www.pitch.law/academy/the-nice-classification-explained). Using harmonised terms avoids classification queries and is also what makes an application eligible for [EUIPO Fast Track](https://www.pitch.law/academy/euipo-fast-track-filing). Where a client's business needs wording that the database does not offer, the attorney decides whether to accept the consequences of a custom term.

### Validation

Before filing, the application is validated against the formal requirements: mandatory fields, representation of the sign, class and fee consistency. Errors that the Office would raise afterwards are caught earlier.

### Filing at the EUIPO

Once you and the attorney have confirmed, your attorney files the application with the EUIPO. The sequence is draft, validate, attorney confirms, attorney files. The filing receipt and the application number are stored with the matter.

### Pre-filled packages for the BOIP and WIPO

For the Benelux Office for Intellectual Property (BOIP) and for international applications under the Madrid System through WIPO, the technology prepares a complete pre-filled package: data, specification and annexes in the form each office expects. The attorney reviews it and files it once confirmed. For Madrid, the package builds on the base mark and the designated countries chosen with the client.

### Handover to the docket

Once filed, the application enters the docket with its dates. Follow-up of the examination, publication and opposition periods continues through the [portfolio and deadline technology](https://www.pitch.law/technologies/portfolio-renewals), and every computed date is confirmed by a person.

The attorney's checks sit at fixed points. The sign and the classes are confirmed before the draft is validated. The specification is read line by line, because wording defines the scope of the right. The territories and the route are confirmed against the client's instructions and the cost overview. Only then is the filing released, and the technology records who confirmed what and when.

Inputs and outputs are kept simple. The input is the client's instruction, the cleared sign and the agreed specification. The output is a validated draft, a filing receipt and a set of docket entries. If the attorney changes anything after validation, the draft is validated again, so the filed version is always the confirmed version. Nothing is sent on a schedule or on the technology's own initiative.

## What you receive

A filing confirmation with the application number and the filed specification, a copy of what was submitted, and an overview of the next expected steps. You will also see the application in the client portal. How the process continues is explained in [the route from application to registration](https://www.pitch.law/academy/trademark-registration-from-application-to-registration).

## Where it is used

For new trademark applications at the EUIPO, the BOIP and through the Madrid System, usually after a clearance and always with a cost overview from the [IP cost estimator](https://www.pitch.law/technologies/ip-cost-estimator). It is also used when an existing mark is extended to further goods or countries.

### A matter from start to finish

A Leuven medical-device start-up has a cleared name and wants protection in the EU and, shortly afterwards, in Switzerland. The attorney opens a draft, enters the applicant and the sign, and selects harmonised terms for class 10 and class 42. Validation flags a missing representation of the logo, which is corrected. The attorney confirms and the attorney files the application with the EUIPO. The receipt is stored. For Switzerland the technology prepares a Madrid package based on the EU filing, which the attorney reviews before it is filed through WIPO within the priority period. Both applications go into the docket with their dates.
