# The Unitary Patent

What unitary effect is, which states it covers in October 2026, how it differs from validating a European patent country by country, and when each route makes sense.

## The legal framework

The European Patent Office grants European patents under the European Patent Convention (EPC), which covers close to forty states, among them the United Kingdom, Switzerland, Norway and Türkiye. A European patent does not by itself give protection everywhere: after grant it has to be validated in each country where it should take effect, with national fees and sometimes translations.

The Unitary Patent is an additional route that sits on top of the EPC. It is based on Regulations (EU) 1257/2012 and 1260/2012 and on the Agreement on a Unified Patent Court (UPCA), and it has been available since 1 June 2023. After grant, the proprietor can request unitary effect, which turns the European patent into a single right with the same effect in all participating states.

### Which states participate

Unitary effect covers the EU states that have ratified the UPCA at the date of registration. As of October 2026 there are 18, including Germany, France, Italy and the Netherlands. Romania joined on 1 September 2024, so a patent whose unitary effect was registered before that date does not cover Romania.

Ireland has signed the UPCA but has not ratified it, because a constitutional referendum is required. The referendum planned for June 2024 was postponed and we have not found a new date. Spain and Poland do not take part in the system, and several other EU states have signed without ratifying. The United Kingdom, Switzerland, Norway and Türkiye are outside the EU system and need national validation.

### How it works

The request for unitary effect must be filed with the EPO within one month of the publication of the mention of grant in the European Patent Bulletin. The patent must have been granted with the same claims for all participating states. During a transitional period, a translation of the patent is required: into English if the proceedings were in French or German, or into any official EU language if they were in English.

Annual renewal fees are paid to the EPO only, from a single payment. They are set by reference to the renewal fees in the four countries where European patents were most often validated. The patent lasts 20 years from filing, like any European patent.

A Unitary Patent is one right. It can be transferred, licensed, limited or revoked only for all participating states together. Disputes about it belong exclusively to the Unified Patent Court, described in [the Unified Patent Court](https://www.pitch.law/academy/unified-patent-court).

## In practice

A machine manufacturer has a European patent granted with the same claims for all states. Its main markets are Germany, France, the Netherlands, Italy, Spain and Switzerland. Unitary effect covers the first four in one step with one annual fee. Spain and Switzerland still require national validation, so the manufacturer pays for three kinds of cost: the unitary renewal fee, two national validations and two national renewal streams.

A Ghent start-up that needs protection only in Germany and France may find that national validation in two countries is cheaper than a unitary patent whose annual fee is calibrated for a much wider territory. The fee cannot be reduced by dropping countries over time, whereas a classic European patent can be pruned by letting national validations lapse.

A third consideration is risk. A single unitary patent can be revoked in one action across all participating states. A patent in a contested field, where competitors are likely to attack validity, may be better kept as a classic European patent in a few countries, possibly outside the UPC by an opt-out. [The Unified Patent Court](https://www.pitch.law/academy/unified-patent-court) explains that choice.

The decision must be taken within one month after grant is published, so it should be prepared earlier. Our [IP cost estimator](https://www.pitch.law/technologies/ip-cost-estimator) compares the scenarios over the life of the patent, and you can try the numbers yourself in the [Unitary Patent calculator](https://www.pitch.law/unitary-patent/calculator). Once chosen, the annual fees are followed in [our deadline system](https://www.pitch.law/technologies/portfolio-renewals).

## Frequently asked questions

### Does the Unitary Patent replace the European patent?

No. It is an option after grant. Many proprietors combine unitary effect with national validation in states that do not take part.

### Can I get unitary effect for a patent granted before 2023?

No. Unitary effect is available for European patents granted on or after 1 June 2023.

### Can I drop countries to save renewal fees?

Not within a Unitary Patent: it is paid and kept as a whole. You can only let the entire right lapse. With national validations you can stop paying in individual countries.

### Does a Unitary Patent cover the United Kingdom or Switzerland?

No. These states are outside the EU system and need national validation.

### Who decides disputes about a Unitary Patent?

Only the Unified Patent Court. National courts have no jurisdiction over it.

## How this connects

The choice between routes is part of [360° patent strategy](https://www.pitch.law/solutions/patent-strategy). Our [patent analysis and research function](https://www.pitch.law/technologies/patent-intelligence) supports the claims and validity questions that come before it, and [the IP portfolio and renewals system](https://www.pitch.law/technologies/portfolio-renewals) follows the fees afterwards.

## In short

- Single right covering 18 EU states, as of October 2026
- Single renewal fee paid to the EPO
- Governed exclusively by the Unified Patent Court
- Non-participating states still need national validation
